1. Scope of application
These Terms & Conditions apply to the use of the Folio platform (folio-travel.com) and all bookings of experiences made via our site.

2. Our role
Folio curates tours and experiences provided by independent local operators. We do not operate or staff the experiences ourselves. All bookings are processed through FareHarbor, and the service contract exists directly between you (the guest) and the operator.

3. Content and descriptions
Experience descriptions, schedules, pricing, and availability are provided by operators via FareHarbor. Folio makes every effort to ensure accuracy but is not responsible for errors, omissions, or changes made by operators.

4. Prices and taxes
Prices displayed are current as provided by the operator. Taxes, service charges, or local fees may apply depending on the experience and location. These are shown during checkout before payment.

5. Booking and contract
By booking through Folio, you are entering into a direct contract with the operator of the chosen experience. Folio acts only as an intermediary and is not party to this contract.

• After booking, you will receive confirmation and further details directly from the operator.

• Payment is processed securely via FareHarbor on behalf of the operator.
   

6. Cancellations and changes
Each operator sets their own cancellation and refund policy, which is displayed during checkout.

• All cancellations, refunds, or changes must be arranged directly with the operator.

• Folio cannot override or amend operator policies.
   

7. Liability
Folio is not liable for:

• the delivery, quality, or safety of any experience,

• accidents, delays, cancellations, or losses during an experience,

• errors in operator-provided content.

Folio remains liable only where required by law (e.g. cases of intent, gross negligence, or harm to life, body, or health).

8. Governing law
These Terms & Conditions are governed by the laws of the State of Hawai‘i, United States.

9. Miscellaneous
If any clause of these Terms & Conditions is found invalid, the remainder will still apply.
